:: Pursuant to a scheduling order that was entered on March 6, 2008, Mr. Holsey filed a motion in the United States District Court requesting discovery. In federal court, Mr. Holsey is not automatically entitled to discovery as he was afforded a discovery period during his state appeal. If the Court grants this motion, Mr. Holsey’s attorneys will be afforded a period of time in which to gather evidence in support of his claims of constitutional violations.
