			<content:encoded><![CDATA[<div class='microid-9c3d65ca51a3f1cfd19a0107fb4abe01e60e6170'><p>Pursuant to a scheduling order that was entered on March 6, 2008, Mr. Holsey filed a motion in the United States District Court requesting discovery.  In federal court, Mr. Holsey is not automatically entitled to discovery as he was afforded a discovery period during his state appeal.  If the Court grants this motion, Mr. Holsey’s attorneys will be afforded a period of time in which to gather evidence in support of his claims of constitutional violations. <p>More than 300 people showed up for the <a href='http://www.willrobinson47.com/wp-content/plugins/auto_links/klogs/?kw=Baldwin County&amp;rl=http://www.baldwincountyga.com' title ='http://www.baldwincountyga.com'  id="al_5">Baldwin County</a> <img src='http://www.willrobinson47.com/wp-content/plugins/auto_links/images/link.gif' alt ='Baldwin County'  /> Sheriff’s Office and Georgia Military College Alumni Association’s 12th annual Will Robinson Memorial Run on Saturday at the North Baldwin Fire Department, braving the 40-something degree weather for a good cause.</p>

<p>“We had a great turnout and the weather was great though a bit chilly,” Baldwin County Sheriff’s Department Chief of Detectives Capt. Christopher Spires said.</p>
<p>Suzanne Ratliff with the GMC Alumni Association was happy with the cool weather and the support of the community and GMC students.</p>
<p>“Cold is better than rain. We were happy with the results, and it was a good turnout,” Ratliff said.</p>
<p>Some excellent times were posted for the 5K or 3.2 miles run, Spires said.</p>
<p>Baldwin High standout Franco Delaluz made it back-to-back wins at the Memorial this year, finishing the 5K in 16 minutes and 36 seconds, Spires said.</p>
<p>“That is a very fast run,” Spires said.</p>
<p>Katherine Lacksen was the female winner with a time of 27 minutes and 47 seconds.</p>
<p>Spires estimates about $11,000 was raised, though that was before paying the costs of the event.</p>
<p>The money raised will go toward two scholarships to Georgia Military College, one being in the name of Will Robinson and the other as a GMC Alumni Association scholarship. The remaining funds will go toward the D.A.R.E. program, Spires said.</p>

<p>Winners in the other categories who received trophies:</p>
<p>— One mile “fun” run male winner — George Bowels</p>
<p>— One mile “fun” run female winner — Cherokee Henry</p>
<p>— Overall public safety winner — McKay Bloodworth with Georgia State Patrol with 23 minutes and eight seconds in the 5K run</p>
<p>— Overall male Baldwin County winner — Fred Eaton with 18 minutes and 13 seconds in the 5K run</p>
<p>— Overall female Baldwin County winner — Lindsay White with 24 minutes and 38 seconds in the 5K run</p>

<p>“I felt it was justice,” Bright said. “I felt that Holsey deserved the death penalty for the murder of sheriff’s deputy Will Robinson.”</p>

<p>The Georgia Supreme Court reinstated Monday the death penalty against a man convicted in 1997 of killing a <a href='http://www.willrobinson47.com/wp-content/plugins/auto_links/klogs/?kw=Baldwin County&amp;rl=http://www.baldwincountyga.com' title ='http://www.baldwincountyga.com'  id="al_5">Baldwin County</a> <img src='http://www.willrobinson47.com/wp-content/plugins/auto_links/images/link.gif' alt ='Baldwin County'  /> sheriff&#8217;s deputy.</p>
<p>Robert Wayne Holsey, now 41, is back on death row for the 1995 killing of 26-year-old deputy William Robinson IV.</p>
<p>Sheriff Bill Massee said he is pleased with the decision and that Robinson&#8217;s murder had a huge impact on the community.</p>
<p>&#8220;It was a very personal case with everyone involved,&#8221; Massee said. &#8220;Everyone in the community has watched this case closely.&#8221;</p>
<p>Robinson was killed in December 1995 while trying to arrest Holsey in connection with an armed robbery. Holsey was found guilty and sentenced to death in 1997.</p>
<p>Last May, Superior Court Judge Neal Dickert of the Augusta Judicial Circuit overturned the death sentence, citing ineffective defense counsel. The judge ruled that Holsey&#8217;s defense did not go far enough in detailing his troubled family background or mental health issues before the jury.</p>
<p>In the appeal, evidence was submitted about the defendant&#8217;s &#8220;limited intelligence, his troubled and abusive home life, his positive contributions at home and elsewhere, and his mother&#8217;s and sister&#8217;s mental health issues.&#8221;</p>
<p>But in a unanimous decision released Monday, the state&#8217;s high court ruled that the additional information wouldn&#8217;t have made a significant difference in the case.</p>
<p>Frank Robinson, William Robinson&#8217;s brother, said he was ecstatic about the reinstatement of the death penalty for Holsey. He said waiting for a resolution in the case has been difficult, but not as difficult as not having his brother around.</p>
<p>&#8220;He was an all-American guy, I guess, smart, fun to be around. He was a good friend and a good brother,&#8221; Frank Robinson said.</p>
<p>Massee said William Robinson&#8217;s death was like the unexpected loss of a family member.</p>
<p>&#8220;The loss is not only immediate, but it is a continuing loss,&#8221; he said.</p>
<p>Fred Bright, the Ocmulgee Judicial Circuit district attorney, said if the Georgia Supreme Court had not reinstated the death penalty, his office would have retried the case.</p>
<p>Holsey can file several other appeals, which could take years to resolve, said Russ Willard, spokesman for the state Attorney General&#8217;s Office.</p>

Harris Hines wrote in the decision that &#8220;introduction of Holsey&#8217;s new evidence at his trial would not have had an impact on the jury&#8217;s sentencing deliberations sufficient to help sustain a successful ineffective assistance of counsel claim regarding the sentencing phase.&#8221;</p>
<p>Holsey was found guilty and sentenced to death in 1997.</p>

<p>Holsey’s appellant attorney argued that the justices should uphold a superior court judge’s ruling earlier this year throwing out Holsey’s death sentence. And the Georgia Attorney General’s Office asked the justices to disregard the judge’s earlier ruling and reinstate Holsey’s death sentence.</p>
<p>Holsey shot and killed <a href='http://www.willrobinson47.com/wp-content/plugins/auto_links/klogs/?kw=Baldwin County&amp;rl=http://www.baldwincountyga.com' title ='http://www.baldwincountyga.com'  id="al_5">Baldwin County</a> <img src='http://www.willrobinson47.com/wp-content/plugins/auto_links/images/link.gif' alt ='Baldwin County'  /> Sheriff Deputy Will Robinson in 1995 after robbing a convenience store. A jury convicted Holsey in 1997 and sentenced him to death for the deputy’s slaying.</p>

vocabulary and an adequate IQ or a record of school failure and a drunk lawyer<br />
who failed to point out his client&#8217;s deficiencies when Holsey was on trial for<br />
his life.</p>
<p>Armed with school records and trial documents, Holsey&#8217;s lawyers and state<br />
prosecutors clashed again Monday before the Georgia Supreme Court to debate<br />
whether he deserves the death penalty for the 1995 killing of a <a href='http://www.willrobinson47.com/wp-content/plugins/auto_links/klogs/?kw=Baldwin County&amp;rl=http://www.baldwincountyga.com' title ='http://www.baldwincountyga.com'  id="al_5">Baldwin County</a> <img src='http://www.willrobinson47.com/wp-content/plugins/auto_links/images/link.gif' alt ='Baldwin County'  /><br />
sheriff&#8217;s deputy.<a id="more-85"></a></p>
<p>Holsey was on death row for the killing of William Robinson when a judge<br />
overturned the sentence in May, ruling that Holsey&#8217;s lawyer didn&#8217;t go far enough<br />
in pursuing a mental retardation defense.</p>
<p>Senior Assistant Attorney General Susan Boleyn told the judges that Holsey&#8217;s<br />
family never brought up mental retardation or a learning disability during the<br />
1997 trial. She also said he had a &#8220;surprising&#8221; vocabulary and a recent IQ score<br />
that landed him out of the range of mental retardation.</p>
<p>&#8220;He didn&#8217;t function in society because he was anti-social,&#8221; she said, not<br />
because of a mental deficiency.</p>
<p>Holsey&#8217;s attorney, Thomas Dunn, said his client had earned lower scores on<br />
the IQ test during earlier takes and logged an adequate score only because he<br />
was given an abbreviated version of the test.</p>
<p>He also noted how Holsey&#8217;s lawyer during the murder trial, Andy Prince, later<br />
testified that during the trial he was drinking a quart of vodka a day. &#8220;He was<br />
an absolute train wreck,&#8221; Dunn said.</p>
<p>Robinson was shot to death in December 1995 after he stopped Holsey&#8217;s car,<br />
which matched the description of a getaway vehicle in the armed robbery of a<br />
convenience store.</p>
<p>Ocmulgee District Attorney Fred Bright has said if the state&#8217;s high court<br />
doesn&#8217;t reinstate the death sentence, he will seek a retrial.</p>
